I don't know about the proximity to the airport but, unless it's still daylight there at 6:45 PM this fellow was clearly outside of VLOS regulations. Under VLOS, you can't fly after sunset.

According to the report here is where he was when charged, end of the runway 34 directly north of his position. Yes sunset is 17:07 at Calgary now so even 30 min for twilight he was in night
