I fly responsibly in the UK, I have permission to fly over a local farmers land with road access to the flying site. I try to abide by the 50m rules and have line of sight to the bird. Do you need permission to fly over private land away from property, buildings and people? I'm talking open land here. I'm not going to argue the point permission is better, just want to know the legal position.

It is my understanding that the land owner does not own the airspace over it, so you can fly as long as you are not breaching any privacy laws.

The CAA are the only people that can tall you you can't be in any given airspace. The exception as you say would be under privacy laws if your fly g is inappropriate.
